Eligibility

To use professional services from AgentTopFirm you must be an eligible individual or entity capable of entering into a binding contract and, where required, authorized to practice or act within the real estate sector in Malaysia.

Users must be at least 18 years old or otherwise have legal authority to enter into contracts on behalf of an organization or minor client.

Services and the website must be used lawfully and for legitimate professional purposes. Misuse of legal advice or attempt to use services for fraudulent activity will result in termination of service and possible legal action.

AgentTopFirm provides legal services targeted to matters governed by Malaysian law. Advice on jurisdictions outside Malaysia may be limited and, when necessary, we will coordinate with qualified local counsel.

Account and Access

Certain features of AgentTopFirm.pro and our client portal require an account. You are responsible for maintaining accurate account information and keeping credentials secure.

Provide truthful and complete information when creating an account or engaging AgentTopFirm. Material inaccuracies may affect the scope or validity of legal advice.

Protect your login credentials. Notify AgentTopFirm immediately if you suspect unauthorized access to your account so we can take protective measures.

Account credentials and any rights granted through an account are personal and may not be transferred without prior written consent from AgentTopFirm.

If you believe your account has been compromised, notify AgentTopFirm without delay. We will take reasonable steps to secure the account and assist with remediation.

AgentTopFirm may suspend or terminate accounts for breach of these terms, suspected fraudulent activity, or by lawful request from authorities.

Scope of Services

AgentTopFirm delivers legal services tailored for realtors including contract review, conveyancing support, compliance advisory, dispute avoidance strategies, and regulatory guidance. Each engagement is governed by a separate engagement letter that specifies deliverables, fees, and timelines.

We may modify service offerings or processes to reflect regulatory changes or operational improvements. Existing engagements will be managed according to their signed terms unless amendments are mutually agreed.

Service availability may vary depending on workload, court schedules, and external factors. AgentTopFirm will communicate realistic timelines and manage expectations based on case specifics.

Conduct and Use Rules

When interacting with AgentTopFirm or using AgentTopFirm.pro, users must follow professional and legal conduct standards. The following are prohibited:

• Submitting fraudulent documents or knowingly providing false information.
• Using the platform to harass, threaten, or defraud other parties.
• Attempting to access restricted areas of the site or interfering with service operation.
• Sharing login credentials or allowing unauthorized third parties to act on your behalf without written authorization.
• Soliciting unrelated commercial activities through our communication channels.
• Violating applicable laws, professional codes, or third-party rights.
• Misrepresenting affiliation with AgentTopFirm or its attorneys.

User-Provided Content

Users may upload documents and provide information necessary for legal services. You retain ownership of your original content, subject to the rights you grant to AgentTopFirm for the purpose of delivering services.

You remain the owner of materials you provide. By submitting content, you confirm you have the right to share it and that it does not infringe third-party rights.

You grant AgentTopFirm a non-exclusive, revocable license to use, store, and process submitted content solely to provide legal services and for archival or compliance needs.

You are responsible for accuracy and completeness of user-provided content. AgentTopFirm will rely on the information supplied to provide objective legal analysis but may verify facts through independent checks where appropriate.

Requests to remove user content will be considered in light of legal and regulatory obligations, retention policies, and the needs of any ongoing engagement or dispute.

Intellectual Property

All intellectual property rights in AgentTopFirm.pro content, templates, and proprietary materials belong to AgentTopFirm or its licensors. Use of such materials is permitted only as part of an authorized engagement and does not transfer ownership.

• Do not reproduce or distribute proprietary documents without written consent.
• Do not remove or obscure copyright, activity, or proprietary notices.
• Do not create derivative works for external distribution without authorization.

Paid Services and Fees

Engagements for legal advice and representation are fee-based. Fees are set out in engagement letters, which specify rates, billing intervals, and expense reimbursement.

Pricing may be hourly, fixed-fee, or contingent as expressly agreed. Estimates will be provided where feasible, but final fees depend on actual time and resources required.

Payments are due according to the terms in the engagement letter. Accepted payment methods and invoicing details will be provided upon engagement.

Where subscription services are offered, terms including scope, billing cycles, and termination rights will be detailed in a subscription agreement.

Refunds are handled case-by-case and subject to the terms of the engagement letter and services rendered to date. Fees for completed work are generally non-refundable.

Either party may terminate an engagement as set out in the engagement letter. Termination may require payment for services performed up to the termination date and reasonable wind-down costs.

Clients are responsible for applicable taxes arising from fees and expenses. AgentTopFirm will include applicable tax charges on invoices as required by law.

AgentTopFirm may adjust fees for new engagements with notice. Existing agreements are governed by their stated fee terms unless amended by mutual written agreement.

Non-payment may result in suspension of services, referral to collection, or termination of the engagement, subject to applicable professional rules.

Professional Disclaimer

Information provided via AgentTopFirm.pro or initial consultations is for general informational purposes and does not constitute definitive legal advice until an engagement is confirmed. Advice is provided on a matter-specific basis after review of all relevant facts and documentation.

Limitation of Liability

To the extent permitted by law, AgentTopFirm's liability for professional negligence or other claims arising from the provision of legal services is limited to direct damages and shall not include indirect, consequential, or punitive damages. Liability caps and specifics will be addressed in engagement agreements consistent with professional rules and applicable Malaysian law.

Third-Party Services

AgentTopFirm may engage third-party providers for ancillary services such as title searches, registry filings, or specialist advice. Use of third parties will be disclosed when material and selected with professional diligence. AgentTopFirm is not liable for third-party performance except where responsibility is expressly assumed in writing.

Termination of Services

Either party may terminate an engagement in accordance with the engagement letter. Termination may be immediate for cause, including breach of these terms or unethical conduct. AgentTopFirm will cooperate with reasonable transition requests to minimize client disruption.

On termination, fees and expenses incurred up to the date of termination become due. AgentTopFirm may retain copies of files for recordkeeping and compliance, subject to retention policies and client instructions regarding transfer of original documents.

Privacy and Data Protection

AgentTopFirm processes personal data in connection with legal engagements. Our privacy practices are described in the Privacy Policy available on AgentTopFirm.pro. By engaging our services you consent to processing as described in that policy for the purposes of delivering legal services.

Communications

AgentTopFirm will communicate by email, telephone, or secure client portal. Sensitive information should be transmitted through secure channels where available. Communications may be recorded for quality and compliance purposes in accordance with applicable law.

Changes to Terms

AgentTopFirm may update these Terms of Service to reflect changes in law, professional practices, or business operations. Material changes will be communicated on the website or by direct client notice when they affect existing engagements.

Governing Law

These terms and any engagement agreements are governed by the laws of Malaysia. Disputes will be resolved under Malaysian law and pursued in appropriate courts or alternative dispute resolution forums agreed by the parties.

Dispute Resolution

Client and AgentTopFirm will seek to resolve disputes amicably through negotiation or mediation where appropriate. Rights to seek judicial relief are preserved, subject to any dispute resolution provisions in engagement letters.
